Today the Law Enforcement Committee of the Verkhovna Rada of Ukraine and the European Union Advisory Mission organized a valuable discussion about Ukrainian law, accountability, and conflict-related criminal cases. We shared analysis of court decisions, and our conclusion that it would be helpful to include more details in Ukrainian law about the definition and elements of international crimes, as well as command responsibility. These changes would help legal professionals to apply international law and would strengthen decisions, so that they are upheld on appeal, including to the European Court of Human Rights.
There was also a discussion of amendments to the law on collaboration activities. In our contribution, we highlighted that these changes can be guided by international humanitarian law and analysis of the human rights situation in occupied territory.
